Brief Summary

This action involved a pedestrian teenager struck by a car while walking within the crosswalk. The boy was crossing the street in the crosswalk in Brooklyn, New York City when he was struck by the defendant driver making a left turn. BBNR made a motion for summary judgment to decide liability as a matter of law and the motion was granted by the court.

Plaintiff’s Motion for partial summary judgment against the Defendant on the issue of the liability is granted. Plaintiff makes a prime face case and Defendant fails to overcame the motion and raise any triable issue of fact.
